  • Medical Report Summary and consultation information: medical or lab reports you upload for a Medical Report Summary, and health information you choose to provide in connection with a consultation made available through the Services, together with consultation records and practitioner recommendations or prescriptions made available through the Platform, where applicable.
  • Payment information: processed directly by our payment processors (Stripe, PayPal) — we do not store full card numbers on our own servers.
  • Content you contribute: messages, photos, videos, recipe entries, and other content you submit.

Information Collected Automatically

When you use the Services, we automatically collect device and usage information, including IP address, browser and device characteristics, operating system, general location (derived from IP address or, with permission, device GPS), referring URLs, and information about how you interact with the Services. We collect this primarily for security, fraud prevention, and analytics.

Information Collected via the Mobile Application

With your permission, we may access your device's camera, photo storage, microphone (for video recording), precise location, and push notification settings. You can change or revoke these permissions at any time in your device settings; doing so may limit certain features. We access these device permissions only where required for the relevant feature and only after you grant permission.

We integrate with Apple HealthKit, Google Fit, and Google Health Connect where you grant permission. Health data you choose to share through these integrations (such as steps and sleep) is used only as described in this Policy and is not sold or used for third-party advertising. We handle this data consistent with Apple's and Google's respective developer guidelines.

Data Collected via the HART Smart Ring and SENSE / SENSE Pro Scale

If you use the HART Ring, we collect heart rate, sleep stage estimates, heart rate variability, calorie expenditure estimates, blood oxygen, skin temperature, and step/activity data via the ring's onboard sensors. If you use SENSE or SENSE Pro, we collect body composition metrics (such as body fat percentage, muscle mass, and related measurements) reported by the scale.

2. How We Use Your Information

We use the information we collect to:

  • Create and manage your account and provide the Services you request, including personalized nutrition and training plans;
  • Assess coaching eligibility, safety and suitability, and determine whether a selected plan may commence, including by reviewing required health disclosures and designated pre-coaching lab-test information;

  • Comply with legal obligations and respond to lawful requests from public authorities.

We do not use your sensitive health information (including biometric, lab, or HART Ring data) for third-party advertising purposes, and we do not sell that information.

3. How We Share Your Information

We share personal information with the following categories of recipients. Where a recipient acts as our service provider or processor, we require appropriate contractual obligations requiring them to protect your information and use it only for the purposes we specify:

  • Payment processing: Stripe, PayPal.
  • Order fulfillment and logistics: third-party fulfillment providers, logistics partners, warehouse partners, shipping carriers, delivery service providers, payment processors, and other service providers, including Amazon Multi-Channel Fulfillment (“Amazon MCF”) where used, solely as necessary to process and fulfill your order, store inventory, package and ship purchased products, provide shipment tracking and delivery notifications, facilitate returns, refunds, replacements or exchanges, detect and prevent fraud, comply with applicable legal and regulatory obligations, and operate and improve our business.

When Amazon MCF is used to fulfill your order, we provide Amazon with the information reasonably necessary to process, package, ship, deliver, and, where applicable, facilitate returns for your order. This information may include your name, shipping address, billing address where necessary, email address, telephone number/contact information, order number, purchased products, and shipping preferences. We do not share more information than is reasonably necessary for these purposes.

Amazon acts solely as our fulfillment service provider. Your purchase is made from us, not from Amazon. Amazon’s handling of information provided for fulfillment is governed by its own privacy and security practices, in addition to the contractual obligations applicable to its fulfillment services. We do not sell your personal information to Amazon or our fulfillment providers, and information is shared solely for the fulfillment-related purposes described above.

4. Cookies and Tracking Technologies

We and our analytics partners (Google Analytics) use cookies and similar technologies to operate the Services, remember preferences, and understand usage. You can control cookies through your browser settings; disabling cookies may limit some functionality.

We recognize and honor the Global Privacy Control (GPC) browser signal as a valid request to opt out of the sale or sharing of personal information and targeted advertising, consistent with the requirements of California, Colorado, Connecticut, and other states that mandate GPC recognition. You can also manage cookie preferences using the banner presented on our website.

5. Social Logins and Wearable Integrations

If you register or log in using a third-party account (such as Google or Apple), we receive the profile information that provider shares with us, typically your name, email address, and profile photo. We use this information only as described in this Policy. We are not responsible for the privacy practices of the third-party provider; please review their privacy policy directly.

6. International Data Transfers

Our primary infrastructure is hosted in India. Certain engineering, product, and operational support functions for FITTR are performed by personnel and service providers located in India. As a result, some personal information may be accessed, processed, or stored by those teams in India, subject to contractual confidentiality and data protection obligations consistent with applicable law, including India's Digital Personal Data Protection Act as its provisions come into effect.

7. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations (such as tax and accounting requirements), resolve disputes, and enforce our agreements. When we no longer have a legitimate business need to retain information, we delete or de-identify it, except where retention is required by law or backup systems.Order and customer information relating to physical product or hardware orders may be retained for as long as reasonably necessary to provide customer support, maintain business records, comply with tax and accounting obligations, resolve disputes, enforce our agreements, process warranty, return, refund, replacement or exchange requests, and satisfy applicable legal requirements. When this information is no longer required for these purposes, it is securely deleted, anonymized, or de-identified in accordance with our record retention practices.

8. Data Security

We maintain an information security management system aligned with ISO 27001:2013 practices, including encryption, access controls, and regular security testing. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We are not currently a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act (HIPAA) for most of our Services, and most health and fitness information we collect directly from you is not subject to HIPAA. We design our security and privacy practices to reflect HIPAA-aligned safeguards as a matter of best practice, but we do not represent that all of our Services are HIPAA-compliant.

9. Age Requirement (18+)

THE SERVICES ARE EXCLUSIVELY FOR INDIVIDUALS WHO ARE 18 YEARS OF AGE OR OLDER. WE DO NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM ANYONE UNDER 18.

If we learn that we have collected personal information from someone under 18, we will terminate that account and delete that information promptly. If you believe a minor has provided us with personal information, please contact us at privacy@fittr.com so we can investigate and delete it.

10. Washington Consumer Health Data

Washington’s My Health My Data Act ("MHMDA") defines "consumer health data" broadly to include information that identifies a consumer’s past, present, or future physical or mental health status — which includes much of the biometric, sleep, heart rate, body composition, and lab data the Services collect. This section applies to all users, not only Washington residents, consistent with our practice of extending Washington’s protections to our full US user base.

Before we collect consumer health data, we obtain your affirmative, opt-in consent, separate from your general agreement to this Privacy Policy. We do not sell consumer health data, and we do not use geofencing technology around healthcare facilities to identify, track, or target consumers.

You have the right to:

  • Confirm whether we are collecting, sharing, or selling your consumer health data, and access that data;
  • Withdraw your consent to the collection or sharing of your consumer health data at any time;
  • Request deletion of your consumer health data, which we will honor by deleting it from our records and directing any processors or affiliates who received it to do the same.

To exercise these rights, contact us at privacy@fittr.com. We will respond within the timeframe required by law. You may also have a private right of action under MHMDA and Washington's Consumer Protection Act for certain violations.

11. Your US Privacy Rights

Depending on where you live, you may have some or all of the following rights under state privacy laws (including California's CCPA/CPRA, and comparable laws in Colorado, Connecticut, Virginia, Texas, and other states):

  • Right to know/access the categories and specific pieces of personal information we have collected about you;
  • Right to delete personal information we have collected from you, subject to certain exceptions;
  • Right to correct inaccurate personal information;
  • Right to opt out of the sale or sharing of your personal information, and out of targeted/cross-context behavioral advertising (as noted above, we do not currently engage in either, but you can still submit a request);
  • Right to limit the use of sensitive personal information (which includes precise geolocation and health data) to purposes necessary to provide the Services;
  • Right to non-discrimination for exercising any of these rights;
  • Right to designate an authorized agent to submit requests on your behalf;
  • Right to appeal if we deny your request, by contacting us at privacy@fittr.com with 'Privacy Rights Appeal' in the subject line.

To exercise these rights, contact us at privacy@fittr.com. We will verify your identity before responding and will respond within 45 days, with one 45-day extension where reasonably necessary, or such other timeframe as required by the law of your state of residence.

12. Do Not Track

Most browsers offer a "Do Not Track" (DNT) signal. Because there is no common industry standard for responding to DNT signals, we do not currently respond to them; however, as noted above, we do honor the Global Privacy Control signal.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new 'Last Updated' date, and for material changes affecting how we use previously collected information, we will provide notice by email or prominent in-app notice before the change takes effect.

14. Data Deletion Requests

You have the right to request that we delete the personal information we have collected about you. This section explains how to submit a request, what to expect from us, and which categories of data we may retain even after a deletion request.

How to Submit a Request

Send a deletion request to privacy@fittr.com with the subject line “Data Deletion Request.” Your request should include:

  • Your full name and the email address associated with your FITTR account;
  • A description of what you would like deleted (e.g., your entire account and all associated data, specific categories such as health metrics or lab results, or data from a specific time period); and
  • Whether you are also requesting account closure, or only deletion of certain data while keeping your account active.

Verification

To protect your information, we will verify your identity before processing a deletion request. Verification typically involves confirming that the request comes from the email address on file for your account. If we cannot verify your identity through that method, we may ask for additional information. We will not use information collected for verification for any other purpose.

You may designate an authorized agent to submit a deletion request on your behalf. We will require written authorization signed by you, or proof of power of attorney, before honoring a request from an agent.

Our Response

We will acknowledge your request within 10 business days and complete the deletion within 45 days. If we need additional time (up to a further 45 days), we will notify you before the initial deadline expires and explain the reason for the extension.

For consumer health data specifically (including HART Ring biometrics, SENSE / SENSE Pro body composition data, and lab results), we will also direct any processors or affiliates who received that data to delete it, consistent with our obligations under Washington’s My Health My Data Act and applicable state law.

If we deny all or part of your request, we will explain why in writing and inform you of your right to appeal. You may appeal a denial by replying to our response email with “Appeal” in the subject line; we will respond to your appeal within 45 days. If your appeal is denied and you are a California resident, you may contact the California Privacy Protection Agency. If you are a Washington resident, you may contact the Washington Attorney General’s Office.

Data We May Retain After a Deletion Request

We may retain certain information even after a deletion request where retention is required or permitted by law, including:

  • Transaction and billing records required for tax, accounting, or legal compliance (typically 7 years);
  • Information necessary to complete a transaction you initiated, honor a warranty, or process a return or chargeback;
  • Information retained to detect, prevent, or investigate security incidents, fraud, or illegal activity;
  • Information subject to a legal hold, subpoena, court order, or ongoing legal proceeding to which we are a party;
  • Aggregated or de-identified data that cannot reasonably be linked back to you; and
  • Information we are otherwise required to retain under applicable federal or state law.

Where we retain data under one of the exceptions above, we will isolate it from active processing and use it only for the permitted purpose.

Note that deleting your data does not automatically cancel an active subscription. If you also wish to cancel, please do so through your account settings or by contacting support-USA@fittr.com before or alongside your deletion request.
